Assisting Buyers and Sellers of Apartments

 

The purchase and sale of a built and registered apartment in one of the registries may seem like a simple transaction. We provide solutions for numerous issues that prevent problems and complications at later stages of the transaction. Our extensive experience is reflected in a special emphasis on tax aspects and various levies, dates and payments, identifying and highlighting potential problems that may arise at any stage of the transaction, checking with the relevant registry, and drafting a "correct" agreement that ensures the physical transfer of the property from the seller to the buyer and its registration.

 

TAMA 38

 

The firm accompanies TAMA 38 projects, construction densification, group purchase transactions, combination transactions, and real estate taxation, under the TAMA 38 plan and its amendments. It grants property owners the approval to demolish the existing structure and build a new residential building that meets earthquake standards, adding floors to the building, or alternatively, strengthening the existing structure against earthquakes while adding floors and new apartments to the existing building. This permit is granted to existing buildings that were not constructed according to Standard 413, to improve their resistance to earthquakes. The plan applies to existing buildings whose building permits were issued before January 1, 1980, or to buildings constructed after this date but not according to Standard 413. Our firm accompanies projects nationwide from the negotiation stage until after signing with the developer for project implementation.

 

Betterment Levies, Property Taxes, Building Fees, and Levies

 

Our firm deals with examining betterment levy charges due to realization constituting a sale or issuance of a building permit. We handle filing objections to betterment levy charges both at the decisive appraiser level, the appeals committee level, and the district court level regarding the authority's charges for betterment levy liabilities.

 

Property Taxes and Building Fees: At the beginning of each calendar year, the local authority issues a property tax charge for each asset - land and\/or building within that authority's jurisdiction. The charge is issued according to tax determinants: area, zone, type of asset, classification; in accordance with the property tax order of each local authority. An objection to property tax charges can be filed.
