Claims for Recognition as IDF Disabled Veterans

Engaged in handling claims for recognition as an IDF Disabled Veteran from the outset.

A claim for recognition as an IDF Disabled Veteran is submitted to the Compensation Officer, the Claims and Eligibility Determination Unit in the Ministry of Defense - Rehabilitation Department.

The claim is submitted in cases of injuries and illnesses that occurred during and due to military service or any other service within the defense system, that is, the causal connection, with the aim of the claim being to establish a direct and strong causal link between the service conditions and the impairment.

Handling the claim includes meetings with the client, drafting the recognition claim, personal accompaniment, and handling of the claim until a decision is reached.

Below is a partial list of impairments (diseases/injuries) for which claims have been submitted by me on behalf of and for the victims, and IDF Disabled Veterans' claims have been recognized. It should be noted that each case is considered on its own merits, based on decisions and judgments made on the subject of the impairment:

* Epilepsy

* Psoriasis
* Asthma
* Cancer
* Gastrointestinal Impairments
* Mental Impairments – Schizophrenia, Combat Shock (PTSD)
* Ear Impairments
* Orthopedic Impairments
* Eye Disease – Keratoconus
* Allergies

Appeals to the Magistrate's Court sitting as an Appeals Committee under the Disabled Persons Law

As part of my work in the field, I am engaged in drafting appeals and appearances in court on appeals against the decisions of the Compensation Officer:

* Appeals against decisions of the Compensation Officer rejecting the causal connection between service conditions and the impairments listed above.

* Appeals against decisions dismissing the case on preliminary grounds such as statute of limitations and choice of rights.

Such an appeal is submitted to the Magistrate's Court sitting as an Appeals Committee under the Disabled Persons Law.

The appeal is submitted in the form of appeal arguments, a supporting affidavit, and backed by a supporting medical opinion in the field of the impairment under appeal.

As part of the legal handling, I maintain direct contact with the specialist doctor in the field, who also accompanies the appeal from the medical perspective.

The work within the appeal includes: meetings with the client, drafting appeal arguments and supporting affidavits, representation, and appearance in court while holding an evidentiary hearing that includes the examination of medical experts, until a decision is reached.


Claims for "Reconsideration"

Unlike other legal fields, where the principle of finality of discussion applies at the end of a process, in the field of medical impairments of IDF Disabled Veterans, given that it is a medical matter, and the daily medical developments, it is possible to reopen a case by way of a "reconsideration" claim, through new documents and medical opinions that were not previously presented to the Compensation Officer.
Appeals to the District Court

Representation in appeals against decisions/judgments of Appeals Committees (Magistrate's Court) and appeals against decisions of Superior Medical Committees before the District Court.

These appeals are submitted on legal issues only.

Handling Claims for Aggravation and Appeals before Medical Committees

The legal handling is carried out by me, providing personal attention, maintaining contact with the client, personal accompaniment, and handling until a decision is reached in each of the aforementioned procedures.
