Real Estate

 

Determining rights in real estate often requires careful and skillful handling, proper tax planning, identifying client needs, and finding appropriate solutions. This is a dynamic field that requires professional understanding and close monitoring due to the development of case law. In most cases, significant tax payments are required, and various approvals must be obtained, without which the transaction will not proceed and may not even be registered.

 

Among the areas the firm deals with are:

 

Guidance in real estate transactions in all aspects, real estate rights, tax planning, asset checks against authorities, drafting and editing of sales contracts or work contracts with contractors, and property registration.

 

Tort Law

 

Tort law deals with situations where a person is harmed in body or property due to a certain factor that is liable to bear legal responsibility and be sued for compensation for the damage caused. Therefore, before suing for a tort, two questions are asked:

 

1. Is there liability on the part of the damage-causing factor?

2. What is the main remedy that can be claimed for the damage caused?

 

In principle, compensation is supposed to restore the injured party to the state they were in before the harmful event occurred, i.e., restitutive compensation, except for punitive compensation provided by law in certain cases or compensation without proof of damage, such as in the case of defamation law or commercial torts law. Therefore, the assessment of compensation and proof of damage requires the skill and handling of a tort expert. The firm's areas include work accident claims, road accident claims, medical malpractice claims, nursing claims, and court representation.

 

Insurance Law

 

Many requests are rejected by insurance companies immediately after submitting a claim for insurance benefits, especially in the field of tort liability and road accidents. Often, insurance companies try to ignore the existence of the insurance contract with common claims, such as non-disclosure of a material fact in the policy and/or an exception in the policy that exempts the insurance company from payment and/or the insurance event did not occur. Extensive experience is required to stand up to insurance companies and reach a settlement without the need for lengthy legal proceedings.

 

Labor Law

 

Labor courts are more attentive than ever to the rights of employees and employers. A large portion of employees are employed under personal contracts where employee rights are defined according to protective laws. Our firm deals with the guidance and preparation of employee and employer contracts, employee protection for violation of their rights, and employer protection in preparing employment agreements and their confidentiality.

 

Execution Office

 

It should be noted that our country holds a respectable position among countries with poor payment ethics. The Enforcement Authority works extensively in arranging and providing appropriate responses to debtors and creditors. Immediately after submitting a request for execution of a bill or judgment, many objections are filed to delay the execution of the bill. A quick and appropriate response often yields success in rapid collection. Since 2010, following Amendment 29 to the Enforcement Law, many changes have occurred in the enforcement offices.

 

Banking Law

 

At the center of the relationship between a bank and its client is the duty to act with caution, good faith, and trust. The legal relationship between them is often prolonged, imposing complex technical actions on the bank, requiring it to act with a high degree of caution and trust.

 

The current tendency is to expand the responsibility of banks towards their clients and third parties. The special status and daily reliance of all layers of the public, the trust the public places in them, the vast information and special means available to them, their deep pockets, and their superior ability to prevent damage from the outset justify such a tendency.

 

Wills

 

A will is a person's desire and right that defines the method of distributing their property and assets after death.

There are four types of wills: oral will, witnessed will signed by two witnesses who testify to its preparation, written will (most recommended), and will before an authority.

 

A written will must be prepared in writing, dated, and signed by the testator. An attorney knowledgeable in will preparation will draft a clear, specific will prepared according to the testator's free will. A testator who fears that the execution of the will may lead to family disputes is advised to prepare their will in the presence of two additional witnesses who have no benefit from the will. The importance of preparing a will lies in the quick distribution of the testator's assets and preventing the need for legal proceedings, which often involve significant financial expenses and delays in the distribution of the estate's assets.
