Precedent-Setting Successes

Over the years, the firm has achieved legal precedents in various fields and brought innovations to the legal arena. Here are some of our successes by field:

Corporate Law:

C.A. 741/01 Meir Kot v. Estate of Yeshayahu Eitan (deceased) - Supreme Court appeal that annulled a share dilution carried out in a company despite the consent of the shareholder who sued, due to the heightened duty of loyalty of managers towards shareholders and failure to provide full information in their possession (this ruling is referenced in dozens of court decisions and cited in many books and articles).
Contract Law:
C.A. 2239/06 Ilan Amir Construction and Investments Ltd. v. Herzliya Municipality - Supreme Court appeal that required the municipality to pay compensation for the prolonged construction of a football stadium caused by significant planning changes made by the municipality, despite the agreement not addressing the delay caused by the municipality's conduct. (This ruling is referenced in dozens of court decisions and cited in legal literature).
Real Estate and Real Estate Taxation:
1) C.A. 9567/12 - Case still pending in the Supreme Court, claiming that the policy of the capital gains tax authorities to collect inflationary tax even when real losses were incurred is a flawed policy and should be annulled.
2) M.A. 002563/00 G.H.L. Ltd. v. Mizrahi Tefahot Bank et al. - Annulment of a real estate sale conducted by a receiver despite the sale already being completed and the buyer being a bona fide third party.
Inheritance Law:
C.A. 6119/95, C.A. 5103-95 Tova Dashet v. Shalom Eliyahu - Supreme Court appeal that invalidated the renunciation of heirs from their share in a will aimed at reverting to inheritance by law, thereby nullifying a condition set by the testator, despite the right to renunciation under the Inheritance Law not being conditional. (This ruling is referenced in dozens of court decisions and cited in many books and articles).
Association Law:
1) C.A. 15088/01, C.A. 3955/05, 39359/05, C.A. 6420/05 Rabbi Nachman Zucker v. 2) C.A. 1470/03, C.A. 7778/09 Association of the Sharon Yeshiva v. Ze'ev Segal - Obligation of a yeshiva that received property to commemorate Holocaust victims to allocate $750,000 for this purpose, despite 50 years having passed since the commitment was breached.
Labor Law:
