Traffic Law Field
Attorney Mirav Hassan has unprecedented achievements and successes in the field of traffic law - DUI cases, driving while disqualified, driving without a license and insurance, requests for disqualification calculation, requests for cancellation of administrative disqualification, presidential pardons, new driver offenses, and more.
Office successes in the field of traffic law:
* A DUI case with an alcohol level of 540 micrograms ended with no penalty at all and no traffic record.
* Refusal to undergo a sobriety\/alcohol test - according to the law, anyone who refuses to undergo a sobriety test is considered as having driven under the influence. The law stipulates a minimum of two years disqualification for an alcohol offense. This case ended with only a 30-day disqualification.
* DUI case - A new driver caught driving under the influence with an alcohol level of 325 micrograms concluded his trial with an amendment to the indictment to driving without control (which prevents him from having to retake the driving test and theory test), and the court, as part of a plea agreement, sufficed with the 30 days disqualification imposed by the police officer. Thus, the case ended with no traffic record for a DUI offense and no disqualification at all.
* A DUI case with an alcohol level of 345 micrograms ended with an amendment to the indictment to driving without control (a lesser offense not aligned with alcohol offenses), and the court sentenced the defendant to only 45 days disqualification, a conditional disqualification, and a moderate fine.
* A speeding case 34 km\/h over the limit ended with no disqualification and a moderate fine of 500 NIS.
* New driver case - Transporting more than 3 passengers without an accompanying adult (the law stipulates a minimum disqualification of 3 months, if the new driver is disqualified for more than 3 months, they must retake the driving test and theory test). The case ended with a 76-day disqualification and a moderate fine, thus avoiding the need for the new driver to retake the driving test and theory test.
* A bus driver who overtook on a red road - a very serious offense with a minimum penalty of 3 months - was disqualified by the court for only 20 days.
* An indictment was filed against my client for driving under the influence of drugs. The indictment was amended so that no offense of driving under the influence of drugs was recorded against him, and the case ended with a 4-month disqualification, a fine, and a conditional penalty.
