In 2019, the Insolvency and Economic Rehabilitation Law, 2018, came into effect. The new law considers the manner of debt repayment by a debtor or corporation that is or may be in a state of insolvency. The rationale underlying the legislation: the economic rehabilitation of the debtor, maximizing the amount of debt repaid to creditors, and reintegrating the debtor into the economic fabric of life. Before proceeding, it is necessary to understand the implications of the new law on the applicant. You are welcome to contact our office to assess your suitability for the procedure at no cost.

Enduring Power of Attorney and Advance Directives for Guardian Appointment and Expression of Will Document.

An enduring power of attorney is a legal document that allows any adult (over 18) to determine how and by whom their affairs will be managed in the future when they are unable to do so themselves, provided they understand the meaning, purposes, and consequences of granting the enduring power of attorney.

The person (referred to as "the appointer") voluntarily chooses, at a stage when they understand and can make and execute decisions, who will manage their affairs and how their life will look if and when their condition deteriorates due to an accident, old age illnesses (such as dementia), mental disability, or intellectual disability that may impair their judgment.

The way to do this is by appointing an attorney-in-fact within the framework of an enduring power of attorney, who will be authorized to act on behalf of that person in the future when they can no longer make or execute decisions regarding their affairs themselves.

Typically, the appointer will choose an attorney-in-fact based on trust and closeness (e.g., spouse, parents, and children) or due to their expertise or professional experience (e.g., accountant or lawyer).

The appointer can grant an enduring power of attorney for all their affairs - personal, medical, and property-related, or only for some of them.

The drafting and signing of the enduring power of attorney are conducted before a lawyer (or a professional if the appointer wishes to draft a medical enduring power of attorney, as detailed later). In addition to the appointer's signature, the attorney-in-fact's signature is also required. These signatures constitute agreement to the content of the enduring power of attorney.

An enduring power of attorney allows the appointer to decide how they and their property will be managed after they can no longer make decisions for themselves. Furthermore, drafting an enduring power of attorney eliminates the need, in due course, to apply to the court for the appointment of a guardian for the body or property, and saves the disputes that sometimes arise among family members regarding the identity of the person to be appointed by the court.

It is important to note that an enduring power of attorney does not replace the need to draft a will.

Do not postpone for tomorrow what can be done today! Contact our office today to draft an enduring power of attorney.
